General Terms and Conditions of Sale

These General Terms and Conditions of Sale ("Terms") govern the distance sale of SENIORBIKE vehicles and related accessories through the website seniorbike.it, pursuant to Legislative Decree 206/2005 ("Codice del Consumo") and Legislative Decree 70/2003 on electronic commerce.

1. Seller

2. Scope and acceptance

The Terms apply to all orders placed through the website. Before submitting an order, the Customer must read and accept the Terms by ticking the relevant box; the accepted version is saved with the order and sent by email together with the confirmation. The Customer may print or save the Terms at any time from this page. If the Customer is a consumer (a natural person acting for purposes outside their trade or profession), all mandatory rights provided by the law of their country of residence remain unaffected.

3. Product and purchase options

SENIORBIKE is a four-wheel electric scooter, sold as a medical aid for personal mobility. The essential characteristics are set out on the product pages. Images and colours are as accurate as possible, but may differ slightly from the actual product due to screen display.

  • SENIORBIKE NOW: vehicle available for immediate delivery, in stock in the chosen colour. The vehicle is reserved at the time of the order.
  • SENIORBIKE PRE-ORDER: vehicle pre-ordered at a special price, with estimated delivery of approximately 3 months from order confirmation.

4. Prices

Prices are expressed in euros. The summary shown before the order is submitted indicates the vehicle price, the VAT applicable according to the country of delivery and the total price. Where the cost of transport is not shown in the summary, it is calculated based on the delivery address and communicated to the Customer before shipping; the website calculator provides an estimate. The reduced 4% VAT applies only to eligible persons, after verification of the documentation required by law.

5. Conclusion of the contract

Submitting the order via the "Order with obligation to pay" button constitutes a binding contractual offer by the Customer. The contract is concluded when the Seller receives the order: the Customer immediately receives an order confirmation by email, containing the order number, a summary of the products, prices, payment and delivery methods, these Terms and Conditions and information on the right of withdrawal. For card payments, the confirmation is sent once payment has been completed.

If, due to exceptional circumstances, the ordered product is not available, the Seller will notify the Customer within 7 days and refund without delay any sums already paid, or offer an alternative which the Customer is free to decline.

6. Payment

  • Via an advisor (always for the PRE-ORDER, optional for the NOW): a SENIORBIKE advisor will contact the Customer to arrange payment by the usual methods, including in instalments. Financing is subject to approval by the lending institution and to the conditions communicated before signing.
  • Credit/debit card (NOW only): immediate payment via the secure Stripe platform; card details do not pass through the Seller's servers.
  • Bank transfer (NOW only): to be made within 7 days of the order, quoting the order number as the payment reference. If payment is not received within this period, the order may be cancelled and the vehicle made available again.

The vehicle is delivered after full payment, unless otherwise agreed in writing (e.g. approved financing). The invoice or tax document is issued in the name of the details provided in the order.

7. Delivery

SENIORBIKE is delivered to Italy and the European countries listed on the website, from the Milan Vignate warehouse, to the address provided by the Customer. Delivery times for the NOW are confirmed after the order is placed; for the PRE-ORDER, the estimated delivery time is approximately 3 months. In any case, delivery takes place within 30 days of the conclusion of the contract (art. 61 Codice del Consumo), unless a different deadline has been specified for the PRE-ORDER and accepted by the Customer. In the event of delay, the Customer may set an additional deadline and, if this is also not met, terminate the contract and obtain a refund.

Upon delivery, the Customer shall check the packaging and the vehicle for damage and note any visible damage on the carrier's document. The risk of loss or damage passes to the Customer when they take physical possession of the vehicle.

8. Right of withdrawal

The consumer may withdraw from the contract within 14 days of delivery, without giving any reason and without penalty. The procedure, return costs, refund and the model withdrawal form are set out on the page Right of withdrawal and returns, which forms an integral part of these Terms.

9. Statutory guarantee and SENIORBIKE 3-year guarantee

For consumers, the statutory guarantee of conformity provided for by arts. 128 et seq. of the Codice del Consumo applies: the Seller is liable for any lack of conformity that becomes apparent within 2 years of delivery. The consumer is entitled to repair or replacement free of charge or, where provided for, to a price reduction or termination of the contract. The defect must be reported within 2 months of its discovery.

In addition, and without prejudice to the statutory guarantee, SENIORBIKE offers a 3-year contractual guarantee under the conditions set out on the page Warranty. Damage caused by improper use, accidents, lack of maintenance, unauthorised modifications and normal wear and tear of consumable components is excluded.

10. Use of the vehicle

SENIORBIKE is a medical aid for personal mobility: it does not require a number plate and, for people with a permanent condition, does not require a driving licence. The Customer undertakes to use it in accordance with the user manual, the traffic regulations applicable in their country, and with due care.

11. Support and complaints

12. Dispute resolution

The consumer may, on a voluntary basis, have recourse to an alternative dispute resolution (ADR) body entered on the lists provided for by art. 141-decies of the Codice del Consumo, in addition to the remedies provided for by law.

13. Governing law and jurisdiction

The contract is governed by Italian law, without prejudice to any more favourable mandatory provisions of the consumer's country of residence. For disputes with consumers, the competent court is that of the consumer's place of residence or domicile (art. 66-bis Codice del Consumo). For business customers, the Court of Milan has exclusive jurisdiction.

14. Personal data

The Customer's data is processed in accordance with the Privacy Policy.
