Privacy Policy

This notice is provided pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 ("GDPR") and Legislative Decree 196/2003 ("Privacy Code") to anyone who visits the seniorbike.it website, completes a form or purchases SENIORBIKE online.
1. Data controller
FILANTE Motors srl, via Isaac Newton 9 – 20016 Pero (MI), Italy – VAT no. 11173950962 – PEC filantemotors@lamiapec.it – email info@seniorbike.it – tel. 02 80 89 77 41. The Controller has not appointed a Data Protection Officer (DPO). For any privacy-related request, you can write to info@seniorbike.it or to the PEC address filantemotors@lamiapec.it.
2. What data we process
- Contact and identification data: first name, surname, email, telephone, city, province, postcode, country, any message.
- Order data: delivery address, tax code (optional), chosen colour and plan, amounts, payment method, order history.
- Payment data: if you pay by card, your card details are collected directly by Stripe; we only receive the outcome and a transaction identifier. If you pay by bank transfer, we process the data contained in the payment instruction.
- Data for the 4% reduced VAT rate: if you request it, the documentation required by law (e.g. disability certification), which may contain data concerning health (Art. 9 GDPR).
- Browsing data: IP address, browser type, pages visited, recorded by our servers for security and operational purposes.
- Source of the visit: only if you consent to measurement cookies, the campaign or website you came from (see Cookie Policy).
3. Why we process them and on what legal basis
- Managing the order and the sales contract, delivery, after-sales support, warranty and withdrawal – performance of the contract and pre-contractual measures (art. 6.1.b GDPR).
- Responding to requests for information, test rides and recalls – pre-contractual measures taken at your request (art. 6.1.b GDPR).
- Complying with legal obligations relating to accounting, tax and consumer protection – legal obligation (art. 6.1.c GDPR).
- Verifying eligibility for the reduced VAT rate – your explicit consent (art. 9.2.a GDPR) and tax obligations (art. 6.1.c GDPR).
- Sending you SENIORBIKE news and offers – only with your optional consent (art. 6.1.a GDPR), which you may withdraw at any time.
- Website security, fraud prevention and the defence of legal claims – legitimate interest of the Controller (art. 6.1.f GDPR).
- Measuring the effectiveness of campaigns (source of the visit) – your consent via the cookie banner (art. 6.1.a GDPR).
Providing the data marked as mandatory is necessary to place the order or receive a reply; without it, we cannot act on your request. Marketing consent is optional, and refusing it has no consequences for your purchase.
4. How we process the data
Data is processed by electronic means, with appropriate technical and organisational measures (encrypted connections, restricted and password-protected access, access logging). We do not carry out automated decision-making or profiling.
5. Who may receive the data
- authorised personnel of FILANTE Motors and SENIORBIKE consultants;
- suppliers acting as data processors (art. 28 GDPR): website hosting and infrastructure, email delivery, IT services;
- Stripe Payments Europe Ltd. for card payments, which also acts as an independent controller for anti-money laundering and anti-fraud obligations;
- couriers and carriers for delivery;
- financial institutions, if you choose to pay in instalments;
- accountants, legal advisers and public authorities where required by law.
Data is neither disclosed nor sold.
6. Transfers outside the European Union
Some providers (e.g. payment, email and cloud infrastructure services) may process data in the United States or in other non-EU countries. In such cases, the transfer takes place on the basis of an adequacy decision (e.g. the EU-U.S. Data Privacy Framework) or the Standard Contractual Clauses approved by the European Commission (Art. 46 GDPR).
7. How long we keep your data
- order data and accounting records: 10 years from the end of the contract (Art. 2220 of the Italian Civil Code);
- warranty and support data: for the duration of the warranty and up to 26 months after it expires;
- enquiries, test rides and recall requests without a purchase: 24 months from the last contact;
- marketing data: until consent is withdrawn and in any case no longer than 24 months from the last contact;
- documentation for reduced-rate VAT: for the period required by tax legislation;
- technical logs: up to 12 months, unless needed to establish unlawful conduct.
8. Your rights
You may request at any time access to your data, rectification, erasure, restriction of processing and portability, and you may object to processing based on legitimate interest (Arts. 15–22 GDPR). You may withdraw your consent at any time, without affecting the lawfulness of processing carried out previously; for promotional emails, the unsubscribe link is also sufficient.
Write to info@seniorbike.it or to the certified email (PEC) filantemotors@lamiapec.it: we will reply within 30 days. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali) (www.garanteprivacy.it) or with the authority of the country where you live or work.
9. Minors
The website and sales services are intended for adults only. We do not knowingly collect data from persons under 18.
10. Changes
We may update this notice; the version in force is always published on this page, together with the date of the last update.
