Right of Withdrawal and Returns

If you are a consumer, you have the right to withdraw from a contract concluded on the seniorbike.it website pursuant to Articles 52–59 of the Codice del Consumo (Italian Consumer Code).

1. Time limit

You may withdraw within 14 days of the day on which you, or a person you have nominated other than the carrier, take possession of the vehicle. You may also withdraw before delivery.

2. How to exercise the right of withdrawal

Before the time limit expires, send a clear statement of your decision to withdraw to FILANTE Motors srl, via Isaac Newton 9 – 20016 Pero (MI), email service@seniorbike.it, PEC filantemotors@lamiapec.it. You may use the model form below, but you are not required to do so. We will confirm receipt of your request by email.

3. Returning the vehicle

The vehicle must be returned within 14 days of notification of withdrawal, undamaged, with its accessories, documents and, where possible, the original packaging. We will arrange collection and transport with you.

Return costs: these are borne by FILANTE Motors, unless the withdrawal is attributable to the Customer's responsibility; in that case they are borne by the Customer, who will be informed before collection.

You are liable only for any diminished value of the vehicle resulting from handling other than what is necessary to establish its nature, characteristics and functioning (Article 57 of the Codice del Consumo).

4. Refund

We will refund all payments received, including standard delivery costs, without undue delay and in any event within 14 days of the day on which we receive notification of your withdrawal, using the same means of payment used for the purchase, unless otherwise agreed, at no cost to you. We may withhold the refund until we have received the vehicle or until you provide proof of having sent it, whichever is earlier. If you purchased with financing, withdrawal also terminates the linked credit agreement without penalty (Article 125-quinquies TUB).
